BOOKING TERMS AND CONDITIONS FOR HOTEL CITTÀ – PH HOTEL GUESTS

These booking terms and conditions for guests (“Booking Terms and Conditions”) apply to bookings made directly with Hotel Città or through an agent appointed by Hotel Città.

These Booking Terms and Conditions do not apply to bookings made through a tour operator (and not directly with Hotel Città or through an agent appointed by Hotel Città). Such bookings shall instead be subject to the booking terms and conditions of the travel organiser.

If you have made your booking by telephone, fax or post without having previously reviewed these Booking Terms and Conditions and, after reading them, you wish to cancel your booking, please return all documentation to Hotel Città or to your travel agency within 7 days of receiving these Booking Terms and Conditions. Your booking will be cancelled and any amounts paid by you will be refunded in full, provided that your stay has not yet commenced. This provision does not apply if the booking was made within 14 days prior to the scheduled start date of your stay.

Booking Terms and Conditions

When you make a booking directly with Hotel Città, you enter into a contract with Hotel Città. The contract shall only be deemed concluded once you have made the payment due for the booking and we have issued you with a booking confirmation.

These Booking Terms and Conditions, any decrees, international conventions, applicable laws governing the liability of hotels and/or hoteliers (“Local Hotelier Regulations”), the booking confirmation and any other written information provided by us and brought to your attention (or, where you have made your booking through a travel agency [the “Stay Organiser”], which we have asked the Stay Organiser to bring to your attention) before confirming the booking with you or the Stay Organiser, together with any other terms that we may agree with you from time to time, form the basis of the contract for all bookings made with Hotel Città.

In the event of any discrepancy between these Booking Terms and Conditions, the Local Hotelier Regulations, any applicable third-party terms and/or international conventions, or otherwise, these Booking Terms and Conditions shall prevail to the extent permitted by law.

Please read these Booking Terms and Conditions carefully before making a booking with us, as, subject to any amendments that we may agree with you from time to time, they set out your rights and obligations and ours. If any provision of these Booking Terms and Conditions is unclear to you, please contact us so that we may clarify its meaning. If you do not accept these Booking Terms and Conditions, you must not make a booking with us.

By making a booking, the Lead Guest:

1. declares that they have the authority to bind all persons named in the booking to the contract;
2. confirms that the information provided for all parties included in the booking is complete and accurate;
3. confirms that they have read and understood these Booking Terms and Conditions and agree, on their own behalf and on behalf of all other persons named in the booking, to be bound by them; confirms that they have read our Privacy Policy, available on our website at hotel-città.com/privacy-policy, and undertakes to provide our Privacy Policy to each person named in the booking;
4. confirms that they are at least 18 years of age and, where requesting services subject to age restrictions, declares that all persons participating in the stay meet the applicable age requirements for such services.

Are you booking a Hotel Package or Hotel-Only Accommodation?

Our obligations towards you vary depending on the type of booking you make.

A “Hotel Package” means a single booking made by a customer within the European Economic Area consisting of hotel accommodation and at least one “other tourist service” which:

1. is not intrinsic to the hotel accommodation;
2. is not purchased after the commencement of the stay;
   • and accounts for a significant proportion of the value of the Hotel Package booking (at least 25% of the value of the Hotel Package booking);
   • or represents an essential feature of the Hotel Package booking.

OR “Hotel-Only Booking” means a booking made by: (i) a customer within the European Economic Area for one or more rooms that does not constitute a Hotel Package; or (ii) a customer from any part of the world outside the European Economic Area for one or more rooms, either independently or together with other tourist services.

For the purposes of these terms:

• Section A sets out the Booking Terms and Conditions applicable to Hotel-Only Bookings;
• Section B sets out the Booking Terms and Conditions applicable to Hotel Package bookings; and
• Section C contains the Booking Terms and Conditions applicable to both Hotel-Only Bookings and Hotel Package bookings.
